Terms of Service

These Terms govern your use of the Chargetide app and website (the "Service"), operated by [Your company legal name, LLC] ("we", "us"). By creating an account or booking a session you agree to them.
1. What Chargetide is
Chargetide is a marketplace that connects people who have a home EV charger or electrical outlet ("Hosts") with people who want to charge an electric vehicle ("Drivers"). We are not a party to the charging session itself. Hosts are independent and are not our employees, agents, or contractors. We do not own, operate, inspect, or certify any charger, outlet, or property listed on the Service.
2. Who can use it
- You must be at least 18 and able to enter a binding contract.
- Drivers must hold a valid driver's license and have the right to operate the vehicle they bring.
- Hosts must have the right to offer the charger or outlet they list (see the Host Agreement).
- One person per account. You are responsible for everything that happens under your account and on devices linked to it.
3. Bookings and payment
- A booking reserves a Host's charger or outlet for a time window at the Host's hourly price. The price shown at checkout includes a 10% service fee. Hosts receive their price less a 10% host fee.
- Payment is processed by Stripe. A hold is placed on your card when you book; you are charged when the session ends or, at the latest, 30 minutes after the booked window. We never see or store your full card number.
- Sessions are billed by reserved time, not by energy delivered, unless a listing says otherwise.
- Chargetide credit (for example a referral bonus) is applied automatically to your next booking, has no cash value, cannot be transferred, and expires 12 months after it is granted.
4. Cancellations and no-shows
- Drivers may cancel free of charge until 12 hours before the window starts. Inside 12 hours, 50% of the booking is charged. After the window starts, the full amount is charged.
- If a Driver does not check in during the window, the booking is treated as a no-show and charged in full.
- If a Host cancels, the Driver is refunded in full. Hosts who cancel repeatedly may have their listing paused.
5. Arrival, conduct, and access
- Drivers receive the Host's address and access instructions only after booking, must arrive within the booked window, park only where instructed, and leave when the window ends.
- Drivers check in through the app on arrival. The app may compare the device's location with the listing to confirm arrival and may ask for a photo of the connection.
- Do not contact the other party outside the app to arrange sessions that bypass Chargetide, harass anyone, or misrepresent who you are or what you have.
- Follow all local laws, including parking and electrical rules.
6. Safety and responsibility
- Hosts are responsible for the safety and legality of their electrical equipment and property. Drivers are responsible for their vehicle, their charging cable or adapter, and for using the equipment as instructed.
- Stop charging immediately and report it if equipment appears damaged, overheats, or behaves abnormally.
- Identity verification, ratings, plate on file, and check-in are trust tools, not guarantees about any person or property.
7. Reports, disputes, and refunds
Either party can report a problem from the booking. We review reports within 24 hours and may, at our discretion, refund all or part of a booking, withhold a payout, or suspend an account. Our decision on a refund between the parties is final as to Chargetide; it does not limit any rights the parties have against each other.
8. Suspension and termination
We may suspend or close accounts that break these Terms, create risk for others, or attempt to defraud anyone, and we may pause listings while we investigate. You may stop using the Service at any time; contact support@chargetide.com to delete your account.
9. Disclaimers
The Service is provided "as is". To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose, and we do not warrant that any charger, outlet, property, vehicle, or person is safe, suitable, or as described.
10. Limitation of liability
To the fullest extent the law allows, [Your company legal name, LLC] is not liable for indirect, incidental, special, consequential, or punitive damages, or for damage to vehicles, property, or persons arising from a charging session. Our total liability for any claim relating to the Service is limited to the greater of the fees you paid us in the 12 months before the claim or $100.
11. Indemnity
You will defend and indemnify [Your company legal name, LLC] against claims arising from your use of the Service, your listing or vehicle, your breach of these Terms, or your violation of any law or third-party right.
12. Disputes with us
These Terms are governed by the laws of [State]. [Any dispute with [Your company legal name, LLC] will be resolved by binding individual arbitration, and you waive the right to a jury trial or to participate in a class action, except that either party may bring an individual claim in small-claims court. A lawyer should confirm this clause for your state.]
13. Changes
We may update these Terms. We will post the new version here with a new effective date and, for material changes, notify you in the app. Continued use after that means you accept the changes.
